1. Acceptance of Terms

By accessing or using LastBlueTape (the "Service"), operated by Yolo3000 LLC ("we," "us," or "our") at lastbluetape.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service does not require account creation. By accessing a shared link or creating a punch list, you accept these Terms.

2. Description of Service

LastBlueTape is a free punch list management tool designed for construction and renovation projects. The Service allows users to create, manage, and share punch lists without requiring an account. Access is granted through signed URLs that encode permissions for viewing and editing lists.

Key features include:

• Creating and managing punch lists with items and photos
• Sharing lists with others via signed links with role-based permissions (owner, editor, viewer)
• Email notifications for list activity
• Photo uploads for documenting punch list items

The Service offers both free and paid tiers. Free lists are available at no cost with certain limitations (30 items per list, 2 photos per item) and expire after 90 days of inactivity. Paid lists offer unlimited items, unlimited photos, and permanent access.

3. Access and Authentication

The Service uses signed URLs as the primary means of authentication. Each signed link encodes specific permissions and is tied to a particular shared access configuration. You are responsible for keeping your signed links secure.

Sharing a signed link with another person grants them the permissions encoded in that link. We are not responsible for unauthorized access resulting from you sharing your links with others.

4. User Obligations

You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Not attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
• Not interfere with or disrupt the Service or servers or networks connected to the Service
• Not use the Service to distribute spam, malware, or other harmful content
• Provide accurate information when using the Service (e.g., email addresses for notifications)

5. Content and Intellectual Property

You retain ownership of all content you create or upload through the Service, including list items, descriptions, and photos ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of operating the Service.

The Service itself, including its design, code, logos, and trademarks, is the property of Yolo3000 LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Yolo3000 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your content

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may stop using the Service at any time. If you wish to have your data deleted, please contact us at support@lastbluetape.com.

10. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
